Trying Times : science and responsibilities after Daubert / Ed. by Vivian
Weil. - Chicago : Center for the Study of Ethics in the Profession, Illinois
Institute of Technology, 2001 - vi, 112 p.

Aus dem Vorwort:
"This collection of papers has its origins in a Symposium that took place at
the annual meeting of the American Association for the Advancement of Science
in February 1997. Titled "The Expert Witness: Professional Responsibility at
the Intersection of Law and Science", the Symposium included three of the four
authors whose papers are included in this volume: judge Barbara Jacobs
Rothstein, Richard A. Meserve, Sheila Jasanoff. Zhe stimulus for the
Symposium was the 1993 Supreme Court decision, Daubert v. Merrell Dow
Pharmaceuticals, Inc., that made judges the "gatekeepers" for scientific
evidence in the courtroom. This ruling added new quandaries to ongoing
discussion about the puzzles of incorparating science in the growing number of
cases requiring scientific evidence. It ignited new debate. In light of the
prescribed changes in the role and responsibilities of judges and the
increasing involvement of scientists, engineers, and physicians in legal
institutions and procedures, the focus on professional responsibility seemed
to offer useful access to the debate."
